Terms and Conditions

Please read the following terms before submitting a commission enquiry. By accepting a commission quote and proceeding with payment, you agree to these terms and conditions.
1. Commissions & Availability
Custom binder commissions are currently available to Australian customers only.
Submitting an enquiry does not guarantee your commission will be accepted. I reserve the right to decline requests based on availability, design requirements or current workload.
Once accepted, I'll discuss your ideas, references and binder preferences before providing a final quote.
2. Deposits & Payments
A $50 deposit is required to secure your commission. This covers the initial cost of sourcing your binder and is deducted from the total commission price.
The remaining balance is due after you approve your sketch and before painting begins.
Painting will not begin until full payment has been received.
Deposits are non-refundable for change-of-mind cancellations once your binder has been purchased or design work has begun, subject to your rights under Australian Consumer Law.
3. Binder Availability
I do not keep blank binders in stock. All binders are sourced from online suppliers or trading card stores.
Binder brands, sizes and colours are subject to availability. If your preferred option is unavailable, I'll contact you to discuss alternatives.
If a suitable binder cannot be sourced and the commission cannot proceed, your deposit will be refunded.
4. Sketches & Revisions
A rough sketch will be provided for approval before painting begins.
One round of reasonable revisions is included in your commission.
Additional revisions, major alterations or changes of mind may incur a fee of $20–$50, depending on the amount of work required. Any additional fees will be discussed and approved before changes are made.
Once the sketch is approved and painting begins, further design changes may not be possible.
5. Artwork Ownership & Copyright
All original sketches, compositions and artwork created by DeathRiddleAU remain my intellectual property, excluding any third-party characters or intellectual property.
Commissioning a binder does not transfer copyright or reproduction rights to the customer.
Sketches supplied during the approval process are for personal review only. They must not be copied, reproduced, distributed, provided to another artist for recreation, or used to create other products without my written permission.
Purchasing a completed binder gives you ownership of the physical item, not commercial rights to reproduce or sell copies of the artwork.
I reserve the right to photograph and display my original artwork in my portfolio and promotional materials, subject to any privacy arrangements agreed with the customer.
6. Turnaround Times
Custom binders generally take 4–6 weeks to complete once the design is approved and payment has been received.
Turnaround times may vary depending on design complexity, supplier availability and current workload.
If you require your binder for a particular date, please mention this during your enquiry. Deadlines are only guaranteed when specifically agreed in writing.
7. Communication & Delays
Please remain reasonably contactable throughout the commission process.
If I require additional information, sketch approval or payment and do not receive a response within 14 days, I may pause your commission until communication resumes.
I will make reasonable attempts to contact you before cancelling an inactive commission.
Any cancellation, retention of payments or handling of unfinished artwork will be assessed according to the work completed, costs incurred and applicable consumer law.
8.Unpaid & Abandoned Commissions
If a customer fails to make payment by the agreed deadline or stops responding to communication regarding their commission, I reserve the right to pause or cancel the order.
If payment remains outstanding after 14 days and reasonable attempts have been made to contact the customer, the commission may be cancelled.
For binders and artwork that remain the property of DeathRiddleAU, I reserve the right to complete, modify, repurpose or offer the artwork for sale to another customer following cancellation.
Any deposits, refunds or outstanding payments will be handled according to the work completed, costs incurred and applicable Australian Consumer Law.
9. Handmade Artwork
Each binder is individually hand painted.
Small variations, visible brush strokes and minor differences from the approved sketch are a natural part of handmade artwork.
Colours may also vary slightly between digital references, photographs and the finished product.
All artwork will be completed with reasonable care and skill.
10. Protective Coating & Care
Finished binders are sealed with a matte protective top coat to help protect the painted surface.
However, these are still hand-painted artworks and should be handled carefully.
Avoid scratching, excessive friction, moisture, heat, chemicals and abrasive cleaning products.
Damage caused by accidents, misuse or improper care after delivery is not covered by my change-of-mind policy. This does not exclude any rights you may have under Australian Consumer Law.
11. Shipping & Collection
Shipping costs will be confirmed before final payment.
Orders are carefully packaged before dispatch. Tracking details will be provided where available.
Please contact me if your binder arrives damaged or there is an issue with your order so I can assess the situation and arrange an appropriate resolution.
12. Cancellations & Refunds
As each binder is commissioned specifically for the customer, change-of-mind cancellations may result in the loss of the deposit or reasonable costs already incurred.
If a commission is cancelled after full payment, any refund will depend on the stage of completion, costs incurred and applicable consumer rights.
If I am unable to complete your commission, I will contact you to discuss an appropriate refund or other resolution.
Nothing in these terms excludes, restricts or modifies your rights under Australian Consumer Law.
13. Pokémon Fan Art Disclaimer
Pokémon and all associated characters, names and intellectual property belong to their respective rights holders.
I do not own or claim ownership of Pokémon or its characters.
My custom Pokémon binders are independently created fan art and are not official Pokémon products. DeathRiddleAU is not affiliated with, endorsed by or sponsored by Nintendo, The Pokémon Company, Game Freak or Creatures.
14. Agreement
By accepting your commission quote and proceeding with payment, you acknowledge that you have read and understood these terms and conditions.
Any agreed changes to your commission, including pricing, revisions and deadlines, will be confirmed in writing.
